Constitution

The Constitution is the supreme rule of the legal system in Timeria, to which all public powers and citizens of the Community are subject since its entry into force on 21 February 2019.

The Constitution was ratified by referendum on 20 February 2019. The promulgation of the Constitution implied the culmination of the so-called federal transition of Timeria, which took place after the collapse of the Senatorial Republic of Timeria in 2018, precipitating a series of political and historical events that transformed the cultural nation into a plurinational federal Community where diverse national identities of old micronations disappeared more than a decade ago in the area of Mazarrón, Murcia, Spain, were integrated.

The Constitution establishes a Federal Republic in the form of a Community, with a territorial organization based on the autonomy of municipalities, regions and nations, governing the principle of solidarity. A Federal Government manages the main areas such as Security, Defence, Foreign Policy and those matters affecting the general interest of the community, while the regions and nations maintain broad self-government in the rest of matters.

The Senate is the representative body of the regions and federated nations of Timeria, acting as a constitutional, federative and legislative body of the Community. It acts as an upper chamber and approves or rejects federal laws that affect the competences of the regions and nations. The Senate of the Republic will consist of 10 seats. Each nation is represented in proportion to the percentage of citizens with the right to vote in the census. The Senate is immediately informed of any session in the Federal Congress, as well as of any initiative presented to the Federal Congress. Senators have the right to participate in the sessions of the Federal Congress. Senators serve a two-year term; they may be re-elected.

The Federal Congress is the supreme federal legislative body, being the lower house of Timeria. Its main task is to represent the will of the people by processing federal laws, electing the President of Timeria and controlling the management of the Federal Government. The Federal Congress will consist of 20 seats. The Congressmen are elected by the citizens of the Community. Congressmen serve for three years.

The Presidency of the Republic acts as the Head of the Community. It directs diplomatic relations, the representation of the Community abroad and the rest of the representative functions of the Community. All persons over the age of thirty who possess community citizenship shall be eligible as candidates for the Presidency of the Republic. Before taking office, the Presidency and the Vice Presidency shall pronounce the following oath or affirmation: “I swear – I promise to maintain the order, the Law and the traditions of the Republic as long as I am in good health to do so”. The Presidency is not responsible for acts committed in the exercise of its office, except in cases of high treason. It can only be accused by the Federal Congress and judged by the Supreme Court. A vote of dismissal of the Presidency of the Republic may be promoted by 10% of the census.

Executive power in the Community is exercised by the Federal Government. The Presidency directs the action of the Federal Government. The Presidency elects its Ministers freely.

During the electoral process, citizens of the Community shall elect an Ombudsman whose task shall be to guarantee the safeguarding of fundamental rights and freedoms and to monitor the effective implementation of the Constitution in the Republic.

Judicial power shall be exercised by independent courts, whose judges shall be elected in the Federal Assembly. Judges shall be independent and their term of office shall end when they retire or lose their electoral rights. The Supreme Court shall decide on any matter relating to the Constitution. Any decision of the Supreme Court is directly binding on all institutions of the Republic. The term of office of Supreme Court justices shall not exceed 5 years.
